Homeowners’ associations (HOAs) are entities created to manage
or regulate, or to enforce covenants and restrictions for, residential
planned communities. An HOA may consist of members, stockholders, or
other owners, substantially all of whom are owners of residential lots
that are part of the residential planned community served by the HOA.
Under 2021 Wisconsin Act 199, HOAs within this state must
annually file public notices with the Department of Financial
Institutions containing certain general and contact information. This
information will be published on the Department’s website for reference
by residents, realtors or other real estate professionals, and any other
member of the public.
If an HOA fails to timely file its initial public notice or any annual
renewal notice with the Department, the HOA will be prohibited from
charging a late fee or other fine for any unpaid assessments owed by any
residential lot owner, or from charging any fee in connection with any
transfer of ownership of a residential lot, until the required notice
has been filed.
